CONTRIBUTION TO THE UNIVERSITY OF SOUTH AUSTRALIA TIME CAPSULE
TERMS AND CONDITIONS
1. I understand that any contribution which I make to the University of South Australia Time Capsule (Contribution) is subject to the following terms and conditions. By submitting a Contribution I confirm that I understand and accept these terms and conditions.
2. I confirm that I am:
(a) a current student of the University of South Australia (University);
(b) a current or past employee of the University;
(c) a past student or member of the alumni* community of the University or its antecedent institutions; or
(d) a supporter of, or collaborator with, the University or its antecedent institutions.
3. I consent to the University (and anyone acting with the University’s authority) using, reproducing, publishing, displaying, altering or editing the Contribution:
(a) for the purposes of, or associated with, the University of South Australia Time Capsule;
(b) for educational or research purposes; and
(c) for business purposes, including promoting the University
4. I consent to the University using my name in association with the Contribution, but acknowledge that the University may determine in its absolute discretion not to publish my name in association with the Contribution.
5. I consent to the provider of any platform used for the Time Capsule:
(a) using the Contribution and any other information provided by me in association with the Contribution or my use of the platform to generate anonymised and aggregated statistical and analytical data (Analytical Data);
(b) using Analytical Data for the provider's internal research and product development purposes and to conduct statistical analysis and identify trends and insights; and
(c) supplying Analytical Data to third parties.
6. I confirm that:
(a) I have obtained consent for the submission of the Contribution to the University of any other person who is shown in, or has contributed to the creation of, the Contribution or any part of the Contribution;
(b) the submission of the Contribution will not breach the privacy, intellectual property or other rights of any other person; and
(c) if the Contribution depicts knowledge of Aboriginal or Torres Strait Islander Peoples, I have taken reasonable steps to ensure protection of Aboriginal and Torres Strait Islander Peoples’ rights to maintain, control, protect and develop their traditional knowledges,
and that evidence of these matters can be provided to the University on request.
7. I acknowledge that ownership of any Indigenous Cultural and Intellectual Property in the Contribution remains with the Aboriginal and or Torres Strait Islander person authorised under traditional law and custom to make decisions about Indigenous Cultural and Intellectual Property.
8. I understand that the Contribution may appear, or be referenced by the University in, any medium, including written and photographic publications, websites, audio, video or other media which may exist in the future.
9. I acknowledge that the publication or display of the Contribution is at the absolute discretion of the University, and that the University may remove the Contribution from publication or display at any time, with no notice to me.
10. I acknowledge that the University may in its absolute discretion abandon or suspend the University of South Australia Time Capsule.
11. I acknowledge that I can request that the University cease publishing my Contribution at any time.
12. I acknowledge and agree that:
(a) the Contribution will not be returned to me either at my request or at the conclusion of the University of South Australia Time Capsule; and
(b) the maintenance, storage, use, disposal and destruction of the Contribution will be at the discretion of the University, subject to legislative record keeping requirements.
13. I acknowledge and agree that:
(a) I have no right to any material submitted for the Time Capsule or to access the object code or source code of any platform, software or system used for the Time Capsule;
(b) any platform, software or system used for the Time Capsule is and remains the property of UniSA or the third party who owns that platform, software or system;
(c) I must not use the Time Capsule (including any relevant platform, software or system):
(i) in any way that causes, or may cause damage to the platform or impairment of the availability of accessibility of the Time Capsule or any areas or service of the Time Capsule;
(ii) in any way that is unlawful, illegal, fraudulent or harmful; or
(iii) in connection with any unlawful, illegal, fraudulent or harmful purpose or activity;
(d) when accessing the Time Capsule (including any relevant platform, software or system), I must:
(i) not impersonate another person or misrepresent that I have authority to act for another person;
(ii) correctly identify myself as the sender of all electronic transmissions which I send in regard to the Time Capsule;
(iii) not attempt to undermine the security or integrity of the Time Capsule (including any relevant platform, software or system);
(iv) not use, or misuse the Time Capsule in any way which may impair the functionality of any platform, software or system used to provide the Time Capsule or impair the ability of any other user to access or use the Time Capsule;
(v) not attempt to view, access or copy any material or data in the Time Capsule other than that which I am authorised to access; and
(vi) not use the Time Capsule in a manner, nor transmit, input or store any data, that breaches any third party right (including intellectual property rights and privacy rights) or is objectionable, incorrect or misleading.
14. I acknowledge that I will not be paid or receive any other form of compensation for submitting the Contribution or for any subsequent use of the Contribution by the University or the provider of a platform for the Time Capsule in accordance with these terms and conditions.
15. I release the University (and anyone acting with the University’s authority) from any claims relating to the use of the Contributions.
16. These terms and conditions will be interpreted and governed by the laws of South Australia.
*University of South Australia alumni definition: A graduate of the University of South Australia or any of its antecedent institutions; a staff member of the University who has served the equivalent of five years full time; Fellows of the University, Doctors of the University and Emeritus Professors of the University.
